  • Registering just a design OR a trade mark is the way to go if resources are only available for one.  A benefit of opting for design registration is the lower fees.  You could wait and see whether the logo works for your business long term before incurring the higher outlay of trade mark registration.
  • Copyright recordal of evidence such as through a statutory declaration is appropriate in any event.  Registering a US copyright can sometimes be a particularly effective form of international protection.

Trade marking a logo

There are 2 points to note about trade marking logos:

  • Logos incorporating a word element or letters. It's necessary to establish whether you may secure exclusivity to these by searching the word to check that there is no conflict with someone else's trade mark.
  • Logos having an image element.  If your logo is an image, we need to establish whether any competitors are using a similar logo.
